UNREASONABLE SEARCHES AND SEIZURES

HISTORY

  • Date of ratification December 14,1791
  • This amendment is part of the Bill of Rights
  • Some people did disagree and others agreed
  • People who disagreed said that there was no reason to search
The Fourth Amendment was ratified on December 14,1791. During this year was when the Bill of Rights was added. They voted for this amendment to become what it is. This amendment is important to Americans because it protects our right to privacy and unnecessary searches.

FOURTH AMENDMENT

  • This amendment protects us from unneeded searches and seizures
  • Police can't come and search or arrest someone without a search warrant
  • There are exceptions and times when search warrants are unnessacery
  • If life is in danger of anyone,police can come in and search to save them
  • If owner gives permission, police can do a search to find evidence

  • Also if the evidence is in plain sight, police can come in to search
  • They can do a search to prevent the immediate destruction

ADVANTAGES

  • This amendment protects the citizens privacy
  • The property of the citizens are safe from unlawful seizures
  • The citizens are safe from being arrested unfairly

DISADVANTAGES

  • It makes searches harder for the police to investigate
  • Some criminals that did the crime are let loose
  • Some people that are innocent are proven guilty but they really aren't

MAPP VS OHIO

  • Police officers came into Dollree Mapp's house without a search warrant
  • Police thought she was housing a bomber and searched her house.
  • While searching they discovered disgusting pictures hidden in a trunk
  • They arrested her and said that her fourth amendment right was broken
  • The fourth amendment protected her from searches and seizures

MAPP VS OHIO

  • She took her case to the Supreme Court
  • There The Supreme Court took a vote
  • It ruled 5-3 vote in favor of Mapp
  • High Court says that unlawful searches and seizures couldn't be used in criminal prosecution
  • In state courts
