2ND AMENDMENT

The Second Amendment of the United States Constitution reads: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."
Ratified: December 15, 1791

REASON FOR AMENDMENT

  • People can protect themselves against the government

ARGUMENTS FOR

  • Individuals can defend themselves

ARGUMENTS AGAINST

  • Arguments with Militia exclusivity, and concerns of individuals
  • Could cause danger

SUPREME COURT DECISION

  • Supreme Court Case- District of Columbia v. Heller
  • Dick Heller sued the District of Columbia to challenge the constitutionality of the Firearms Control Regulations Act of 1975.

CONTINUED

  • This act stated that residents of the District could not own handguns and automatic or semi-automatic firearms.
  • The Supreme Court determined that this ban violated the Second Amendment.

RELATING TO BUSINESS LAW

  • By allowing guns it creates jobs for people to sell them
  • People can hunt
  • By hunting the people keep down the population of whatever animal they're hunting

EXTRA CREDIT

  • Supreme Court Case: McDonald v. Chicago
  • A Chicago ordinance existed which banned the possession of handguns
  • Otis McDonald argued that the Second Amendment applies to individual states

CONTINUTED

  • The Supreme Court ruled that the right of an individual to "keep and bear arms" is incorporated by the Due Process Clause of the Fourteenth Amendment and does not apply to the individual states
