THE DAWES ACT OF 1887

The Dawes Act of 1887 provided for the allotment of land to several Indians living on reservations.

AMOUNT OF SECTION ALLOTED

  • Head of a family: 25%
  • Single over 18: 12.5%
  • Orphan under 18: 12.5%
  • Single person under 18: 6%

Section 5:
States that any land alloted will be held by the U.S. For 25 years in trust for the benefit of the Indian who received the land.

Section 6:
States that any Indian alloted land is subject to U.S. law; civil and criminal.
Any Indian who has accepted civilized life will be declared a U.S. citizen.

Section 10
States that anything in the Dawes Act will not affect the power in Congress to grant land to any Indian or tribe for use of railroads, highways, or other public use.
