Some Attempts to Fix It

Individuals with Disabilities Education Act

  • Enacted in 1997
  • Meant to help those children that have a disability, physical or mental
  • Students with an identified disability are to have an Individual Education Plan (IEP) to help them achieve in school.
  • Teachers are required, under this legislation, to accommodate these students according to their IEP

Title IX and Sex Discrimination

  • Enacted in 1972, revised in 1998
  • Meant to provide a non-discriminatory approach based on gender to all education programs or activities
  • Every student, regardless of gender, shall be allowed the opportunity to participate in any educational program or activity that receives Federal funding.
  • Teachers cannot bar any student from participating in any school function based on gender.

Javits Gifted and Talented Students

  • Originally passed in 1988
  • Meant to support those students identified as gifted and talented
  • This act is meant to provide a means for schools to acquire grants to help those students identified as gifted and talented to develop their abilities further.

Gifted and Talented cont.

  • Any gifted and talented students within a school are to be provided with the environments and opportunities to advance their capabilities.

Title I

  • Enacted in 1965
  • Meant to help those students identified as Disadvantaged
  • Established minimum proficiency levels on challenging state academic achievement standards and assessments.
  • Teachers can use the data from the assessments to individualize the education of their students to help them reach at least the minimum proficiency level.

Section 504

  • Enacted in 1973
  • Meant to help those students with an identified disability of any kind
  • Requires that school districts provide a free appropriate public education to qualified students.

Section 504 cont.

  • Teachers are required, under this section, to provide any and all accommodations to the student in order for them to receive their appropriate education.

Lau Remedies

  • U.S. Supreme Court Case from 1974
  • Meant to help those students with limited English proficiency or identified as English language learners
  • The case resulted in schools being required to provide bilingual education opportunities to those students identified as ELL or have LEP.
  • Teachers must be conscientious of their students who do not speak English as their first language. They are required to accommodate those students however possible.
