Oral Arguments:
McDonald claimed that Domino's had ended its contract because he was black, and that he therefore had a right to sue under the Civil Rights Act.

Domino's said that McDonald had not been a party to the contact (it had been between Domino's and JWM) and therefor did not have standing to sue.

Majority Justices:
Scalia, Roberts, Stevens, Kennedy, Souter, Thomas, Ginsburg, Breyer.

Alito took no part in consideration or decision of the case.

The Court ruled unanimously, in an opinion by Justice Antonin Scalia, that because agents of parties to contracts do not personally have rights under those contracts, they cannot state a claim under section 1981.

There were no dissenting justices.

Dominoes won the court case.
