Problem:

  • A.2.d. Inability to Give Consent
  • "Mom" is out of state and does not consent to treatment for her daughter
  • Must choose whether to see client, who is a minor without both parents cons
  • Not legally an issue: FL State Statute: §61.13(2)(b)(2)

Ethical Dilemma

  • To treat minors without consent of both parents with joint custody
  • Refusing treatment without consent harms client
  • Must consider the ethical principles-non=maleficence, beneficence, justice

Possible Actions

  • See the minor with only one consent--liable to end up in court
  • Do not treat client
  • Have parent out of town fax consent*
