  • Everson said tax money was for public education was used for private schools
  • The private schools provided religious education on behalf of a certain church
  • Everson claimed it violated the first amendment, for "establishment" of religion

BILL OF RIGHTS

The first amendment prohibits states from establishing an official religion

COURT'S RULING

5-4 in favor of allowing reimburse parents for the cost of transport

OPINION OF AGREED PARTY

New Jersey's interpretation under the first. The benefits shouldn't be taken away

EXPLANATION

The state cannot establish a set religion. Must be a separation of church and state
