Five Key Ideas

Dispute Resolution in Special Education BY: Mike Phillips

Main Idea # 1

  • Our goal in working special education students should be to focus on effective communication between school personnel and parents.
  • IEP team must work together collaboratively
  • Student success should always be the focal point.

Main Idea # 2

  • The law in IDEA incorporates strategies for potential disagreements between school and parents regarding students special education services.
  • The goal is always to work together; however, it is understood that disagreements are bound to occur.

Main Idea # 3

  • IEP Faciliation
  • Mediation
  • Resolution
  • The above three strategies (introduced by CADRE) should be exhausted in an effort by the school to resolve issues with parents prior to Due Process (See last slide for information on this)

Main Idea # 4

  • FOLLOW THE LAW
  • While it is important for the IEP team to work together and try to come to a consensus, It is understood that disputes will inevitably occur.
  • The resolution process has to be followed by law (IDEA)

Main Idea # 5

  • The goal should be to resolve the issue using all of the steps (IEP facilitation, mediation, and resolution before it comes to Due Process.
  • In Due Process, parents have the right to an impartial hearing officer and to present evidence and witnesses at the due process hearing
