1.

CRIMINAL PRETRIAL

  • An arrest is made if suspicious activity
  • The grand jury decides if there is enough evidence to proceed with prosecution, if not it is dismissed
  • If an indictment is issued, the prosecuting attorney for the government seeks an arrest warrant.
  • The defendant can surrender
  • The defendent will meet with a pretrial officer

CRIMINAL PRETRIAL

  • The defendent appears before a magistrate judge to hear charges
  • The defendent is asked if he/she has an attorney
  • If he can not afford one then one is chosen for him
  • If the governments attorney seeks to have the defendent detained until trial
  • The defendent is represented by a lawyer and must be present

CRIMINAL PRETRIAL

  • The defendent is either released on bail or kept in custody
  • If release he must follow conditions like drug test weekly
  • If later plea changed to guilty a hearing is scheduled
  • If plea guilty, the defendent must meat with a probation officer
  • If plea not guilty, the attorneys will begin repairing for trial

  • The government must disclose evidence so that attorney can prepaid
  • Both sides can file pretrial motion seeking Information for ruling from judge
  • Defendent can suppress evidence, statements, or identification.

  • Defendent-an individual accused in a court of law
  • Arrest warrant-a warrant issued by a judge that authorizes an arrest
