Individuals with Disabilities Education Act

IDEA

  • The IDEA act was first passed in 1975. Under IDEA, schools are required to give special education and related services to children with disabilities.
  • The purpose of IDEA is to provide appropriate access to public education to all children.
  • Schools are required by law to find and evaluate students with disabilities at no cost to parents and provide qualifying students with an IEP.

Significance for Teachers

  • AS TEACHERS, IT IS OUR RESPONSIBILITY TO BE AWARE OF THE EDUCATIONAL RIGHTS OF EACH STUDENT.

Title IX & Sex Discrimination

Title IX & Sex Discrimination

  • Designed to limit discrimination of sex and sexual harassment in public schools.
  • Created to stop the discrimination based on gender from any federally funded program.
  • Schools are prohibited from restricting admission, financial aid, or participation in any federally funded program.
  • Teachers are not allowed to prohibit any child from any activity in the classroom based on sex.

Jacob Javits Gifted and Talented Students Education Act

Javits

  • Focuses resources on identifying and serving students who are traditionally underrepresented in gifted and talented programs.
  • Schools are required to meet the education needs of all GT students.

Javits

  • The purpose of the Act is to orchestrate a coordinated program of scientifically based research, demonstration projects, innovative strategies, and similar activities that build and enhance the ability of elementary and secondary schools.

Significance for Teachers

  • To be able to recognize possible gifted and talented students and assist them appropriately.

Title I

  • Purpose is to ensure that all children have a fair, equal, and significant opportunity to obtain a high-quality education and reach, at a minimum, proficiency on challenging State standards and assessments.
  • Schools are required to provide educational services to students who are educationally disadvantaged or at risk of failing to meet state standards.
  • Teachers are held accountable for making sure each student is provided educational services to meet state requirements.

Section 504 of the rehabilitation act

Section 504 of the Rehabilitation Act of 1973 & 1974

  • Designed to protect the rights of individuals with disabilities in programs and activities that receive Federal financial assistance from the U.S. Department of Education (ED).
  • Section 504 regulations require a school district to provide a "free appropriate public education" (FAPE) to each qualified student with a disability who is in the school district's jurisdiction, regardless of the nature or severity of the disability.
  • No matter the disability or severity, teachers are required to educate all of their students equally.

Lau v. Nichols

Lau v. Nichols

  • The purpose of this ruling was to ensure that ELL's have the same opportunities as native English speakers.
  • Schools are required to provide assistance to ELL's so that they have the same opportunities as any other student.
  • Teachers need to provide as much assistance to ELL's as possible.
