CHEROKEE NATION V. GEORGIA

  • Indians aren't given basic rights
  • Marshall "Indians domestic dependent nations"
  • Jackson wants to rid of Indians altogether
  • Cherokee's are desperate to make a treaty with US

TREATY PARTY

  • Indians formed a political party
  • John Ross is leader
  • All wanted a Treaty instead of removal
  • Treaty Party didn't have any power
  • Jackson shot down all ideas of a treaty

JOHN ROSS

  • Only Indian in appearance
  • Rich, plantation owner, owned slaves
  • Leader of the Cherokee Nation
  • Could not get Jackson to compromise

THE TRAIL OF TEARS

  • May 23, 1836-Two years for the Indians to be gone
  • Pres. Van Buren uses military force
  • 800 mile nightmare (land reserve west of Mississippi)
  • 8,000 Indians died on the Trail.
  • Cruel, harsh conditions

JACKSON'S JUSTIFICATION

  • Indians uncivilized
  • Separate nation
  • Their constitution never elected by US
  • Their main culture is withered
  • Uneducated

INDIANS JUSTIFICATION

  • Fit into American society
  • Unconstitutional rights given to them
  • Helped America with important battles
  • Were not a threat to Americans
