On may 23 police received an anonymous tip stating a wanted persons was in maps house. Upon arrival police were refused entry due to the lack of a warrant. They left and came back with a piece of paper they wouldn’t let mapp or her lawyer see and broke into the house finding the wanted person in the basement.

The constitution protects against unreasonable searches and seizures. This means without a warrant they can’t search her house.

On one side of the case, the police knew that she was housing a fugitive from the tip, but on the other side they did not have a warrant and therefore were unconstitutional in searching the house. The court ruled in favor of Mapp.
