SUMMARY

  • William Marbury was appointed judge at the end of president Adams term but his administration slip never delivered to him before Jefferson took office.
  • James Madison refused to deliver it to Marbury so he sued Madison in Supreme Court

DECISION

  • Chief Marshall indicated that president Adams signature completed Marbury's appointment, but Supreme Court couldn't give Marbury the appointment because his case didn't qualify for original jurisdiction

SIGNIFICANCE

  • Was the first U.S. Supreme Court case to apply the principle of Judicial review
  • Judicial review is the power of federal courts to void acts of congress in conflict with the constitution
