What are the Miranda rights?

The Miranda Rights is the speech that the police must give you when you are arrested.

THE SPEECH

  • You have the right to remain silent when questioned.
  • Anything you say can and will be used against you in the court of law.
  • You have the right to consult an attorney before speaking to the police.
  • You have the right to have an attorney present during questioning.
  • If you can not afford an attorney one will be appointed to you before questioning.

THE SPEECH

  • If you decide to answer questions now without an attorney you still have the right to stop talking and consult an attorney at anytime
  • Knowing and understanding your rights as they have been explained, are you willing to answer any questions without an attorney present

Miranda v. Arizona
In this case of 1963 Ernesto Miranda was arrested for kidnapping and rape.

Miranda was not aware of his rights because he was not informed of them. He gave a full confession.

Miranda's attorney later found out about this later in the case. He took it to the Supreme Court and they ruled in a 5-4 decision that every suspect must be informed of there rights before questioned.

I think that this is very important. What if you were being arrested for a crime you didn't commit and didn't know your rights and you go to jail?
