FIFTH AMENDMENT

WHAT IS THE FIFTH AMENDMENT ABOUT?

  • protects American citizens from potential government abuse relating to criminal cases
  • five clauses

GRAND JURY

  • means a case should go t a grand jury before a trial
  • for a trial, there needs to be sufficient evidence
  • one exception is if a person in the military commits a crime during a state of national emergency or war

DOUBLE JEOPARDY

  • American citizens protected against a second prosecution for the same crime

SELF INCRIMINATION

  • government does not have the power to make a person testify against himself/herself

JUST COMPENSATION

  • government can't take someone's property without paying them back
