PRESENTATION OUTLINE

Negotation

  • Good first choice. least amount of division
  • A more team oriented approach.

Mediation

  • Good choice if Negotiation doesn't work out.
  • Mediator doesn't work for either side their only desire is to get an agreement.
  • Less stressful because mediator works with each side separately.

Due process hearing

  • More formal way of doing things
  • only works for special ed not general ed.
  • As with mediator hearing officer is impartial.
  • Both sides present evidence and witnesses
  • Unlike mediation hearing officer will render a decision that can be challenged in court

Lawsuit

  • must be filed within 90 days of due process hearing result
  • both sides must have lawyers
  • You can only file a civil suit after due process finished.

State complaint

  • You must be able to prove school district broke the law.
  • Can enter it with other parents as a group
  • you need to include your child's struggles, how you have interacted with the school, evidence showing how school broke the law
  • Very involved, talk to a lawyer before proceeding

OCR Complaint

  • Must be filed within 180 days of schools violation
  • Can lead to an investigation of the school
  • It is a federal complaint not a state complaint
