Negotation
Good first choice. least amount of division
A more team oriented approach.

Mediation
Good choice if Negotiation doesn't work out.
Mediator doesn't work for either side their only desire is to get an agreement.
Less stressful because mediator works with each side separately.
3.
Due process hearing
More formal way of doing things
only works for special ed not general ed.
As with mediator hearing officer is impartial.
Both sides present evidence and witnesses
Unlike mediation hearing officer will render a decision that can be challenged in court

Lawsuit
must be filed within 90 days of due process hearing result
both sides must have lawyers
You can only file a civil suit after due process finished.
5.
State complaint
You must be able to prove school district broke the law.
Can enter it with other parents as a group
you need to include your child's struggles, how you have interacted with the school, evidence showing how school broke the law
Very involved, talk to a lawyer before proceeding
6.
OCR Complaint
Must be filed within 180 days of schools violation
Can lead to an investigation of the school
It is a federal complaint not a state complaint
