The case background

  • Miranda raped and kidnapped a 18 year old girl and was later arrested but was not informed of his right.
  • After Miranda was charged with rape he appealed the sentence and brought his case to untied states supreme court.

5th & 6th Amendment

  • 5th:No one can be charged without being informed of his or her right
  • 6th:They must provide a jury trail and it must be speedy and public
  • these were the amendments that were introduced in this case

Ruling

  • the supreme court ruled 5-4 in favor of miranda.
  • this decision gave rise to what became known as the Miranda warning.
  • The Miranda is a right to silence warning given by the police

impact

  • the decision of Miranda v. Arizona led to the creation of something very important that is practiced up to this day known as Miranda rights.
