  • The federal regulations for IDEA 2004 include a section (Subpart E) called Procedural Safeguards

CONSENT

to give (or not give) PERMISSION for action 

Consent

  • You may give or deny consent to an evaluation or other actions
  • You may agree or disagree with decisions made by the school.

Notice

  • You have a right to receive a written explanation of your rights in understandable language

Notice

  • If changes are made in regards to your child's educational identification, evaluation or placement, you must be notified in writing.

Notice

  • If your request for a specific action has been denied, you must be notified in writing along with the rationale for refusal.

Active Participant

  • You are a part of the IEP team.
  • You have a right to participate in meetings determining the educational identification, evaluation, placement or provision of education for your child.

Access

  • You have a right to read, review and request copies of educational records and findings from evaluations
  • You and your family also have a right to confidentiality

Access

  • You can request that your child’s records be amended or your explanation can be attached to your child’s records if not amended

Evaluations

  • If the school suspects your child has a disability, it must evaluate your child at no cost to you.

Evaluations

  • If the school refuses your request for an evaluation:
  • Ask the school for information about its special education policies and the steps for appeal
