Police search without consent

 

"the Fourth amendment to the constitution, intact for over 200 years, guaranteed that the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated."-Kenneth Eade

The Founding Fathers wrote a Bill of Rights to protect the people

The Bill of Rights included certain unalienable rights

life, liberty, and the pursuit of happiness are unalienable rights

liberty includes the right to be free from oppressive government

The police represent a part of the government

police require consent to search your vehicle under certain conditions

Your vehicle cant be stopped unless you commit a crime or traffic offense

Committing a crime gives the police a right to search without consent

A traffic offense gives the right to search without consent if State allows

If your State says you cant be arrested

for the traffic offense, you are free from a search without consent

life, liberty, & happiness from the Bill of Rights

are protected as a result of the Fourth Amendment

Terry v. Ohio says the stop has to be legal and the officer's actions must be related to the stop
