THE CRIME IS COMMITED

SOMEONE IS KILLED. POLICE WILL DO AN INVESTIGATION TO GATHER EVIDENCE.

However, police will not be able to conduct a search on private property. This is protected by the 4th amendment.

ARRESTED
The police will arrest the suspect and tell them that they have certain rights.

The first right/Miranda Rights

  • You have the right to remain silent. Anything you say can and will be held against you in court.
  • Protected by the 5th amendment
  • If you killed someone and chose to stay silent, the authorities would not be able to hold what you say in custody against you when you go to court.

The 2nd right

  • Protected by the 6th amendment
  • The right to have an attorney present during questioning
  • Your attorney is called a defense lawyer or attorney and they will help you throughout the court process.

The third right

  • The right to have a court appointed attorney if you cannot afford one
  • Also protected by the 6th amendment

  • The right to stop answering questions at any point
  • Protected by the 5th amendment

INDICTMENT
The suspect is informed of what they have been accused of. The prosecution lawyer brings forth the evidence and the reason the defendant has been accused. The prosecution lawyer is working against you.

ARRAIGNMENT
The defendant will either plead guilty and accept a plea bargain, or not guilty. A plea bargain will ensure that the defendant will be less punished.The trial date is set.

TRIAL

  • The prosecution and defense present cases to the judge and the jury.
  • The judge and jury will reach a verdict.

SENTENCING
The jury and judge will either find them guilty or not guilty.

Not Guilty

YOU HAVEN'T KILLED ANYONE. CALLED ACQUITTAL. THE ACCUSED GOES FREE.

Guilty

  • The judge sentences the defendant.
  • If convicted of manslaughter, the convict will be sentenced to at least one year of prison.
