  • In pre-Revoluntionary America.
  • Also the 4th Amendment was introduced in Congress in 1789 by James Madison.

  • Three men frisked by police after found pacing in front of jewelry store
  • Illegal concealed weapons discovered
  • Defendents convicted and appealed, claiming their 4th amendment rights were trespassed
  • Outcome: police did not violate 4th amendment

  • Post-9/11: relationship between the government and people changed
  • Los Angeles: under ordinance, police are allowed to demand information from hotels
