Free Speech vs. Hate Speech

For my grade 11 English class in Toronto, after one of my students thought it was ok to say he agreed with ISIS because it was "just his opinion" and "free speech, miss!"

FREEDOM OF EXPRESSION

WHAT IS IT?

ARTICLE 19 of the United Nations Declaration of Human Rights (UNDHR) states that people everywhere have the right to express themselves freely, access information and enjoy freedom of the press.

Freedom of expression is the right to speak

It is the right to voice political, cultural, social and economic opinions
It is the right to dissent
It makes electoral democracy meaningful and builds public trust in administration.

The Constitution of Canada incorporates the Canadian Charter of Rights and Freedoms. Section 2 of the Charter grants to everyone, among other things, freedom of conscience and religion, and freedom of thought, belief, opinion and expression, including freedom of the press and other media.

HOWEVER

AT THE SAME TIME, THERE ARE LAWS AGAINST HATE SPEECH

Hate speech - outside the law, is speech that attacks a person or group on the basis of attributes such as gender, ethnic origin, religion, race, disability, or sexual orientation

In law, hate speech is any speech, gesture or conduct, writing, or display which is forbidden because it may incite violence or prejudicial action against or by a protected individual or group, or because it disparages or intimidates a protected individual or group.

Section 319 of the criminal code of Canada prescribes penalties from a fine to imprisonment for a term not exceeding two years for anyone who incites hatred against any identifiable group. The Code defines an "identifiable group" as "any section of the public distinguished by colour, race, religion, ethnic origin or sexual orientation."

The first two issues of Dabiq (the ISIS magazine)are focused on the establishment of the Caliphate and calling Muslims all over the world to join the nascent state. After the American led airstrikes started in August 2014, the tone of the magazine shifted dramatically. In addition to proclaiming victories in Syria and Iraq, the magazine’s authors began calling on Muslims everywhere to kill civilians in “crusader” nations. Dabiq writers use the deaths of Muslim civilians from American airstrikes as justification to murder civilians in Western nations. Their sense of justice is that of violent retribution.

You have freedom of speech, but not freedom from the consequences of it.
If you use hate speech, most people will still think you're being a jerk.
And in Canada, you could still go to jail.
