WHAT IS A DEATH PENALTY?

ARE THERE DIFFERENT TYPES?

  • electrocution
  • lethal injection
  • Firing Squad
  • Gas chamber

HOW IS electrocution USED

  • person is strapped to a specially built wooden chair
  • electrocuted through electrodes placed on the head and legs
  • alternating current would be passed through the individual's body
  • order to cause fatal damage to the internal organs

IS ELECTROCUTION STILL USED TODAY?

  • As of 2013, Yes.
  • States such as Alabama, Florida, Kentucky
  • Still use this as an option for death penalty

HOW IS LETHAL INJECTION USED?

  • Lethal injection involves injecting chemicals into the veins
  • for the express purpose of causing immediate death.
  • It kills the person by first putting the person to sleep
  • then stopping the breathing and heart, in that order.

IS LETHAL INJECTION STILL USED TODAY?

  • As of Jan 2014, Yes.
  • Florida, Texas and Ohio use it

HOW IS FIRING SQUAD USED?

  • firing squad involves being shot to death by armed individuals
  • particularly common in the military and in times of war.
  • all members of the group are instructed to fire simultaneously,

  • Execution by shooting is a fairly old practice.
  • But yes, Oklahoma and Utah still use it

HOW IS A GAS CHAMBER USED?

  • whereby one is placed in a chamber filled with poisonous gas
  • Breathes it in and eventually dies
  • Commonly used during the holocoustt

IS IT STILL USED TODAY?

  • Yes but rarely used
  • Authorize lethal gas if lethal injection cannot be administered
  • Arizona, California, Maryland, Mississippi, Missouri and Wyoming
  • Still use this death penalty as secondary resort.

HOW LONG DOES ONE WAIT ON DEATH ROW?

  • In 2010, a death row inmate waited an average of 178 months
  • Generally a long time.
  • Some inmates have waited a decade on death row

WHAT IS THE PROCEDURE FOR DEATH ROW?

  • The death penalty appeals process involves state and federal courts
  • and direct and post-conviction review of a death sentence
  • First, they may raise the claim on direct appeal
  • Second, they may petition for state habeas proceedings
  • 3rd at the conclusion, they may petition for federal habeas corpus.

PROS FOR DEATH PENALTY

  • Society is justly ordered when ea. person receives what is due to him
  • Common sense, tells us that the death penalty will deter murder.
  • The death penalty honors human dignity by treating the defendant

CONS FOR DEATH PENALTY

  • Death sentences are imposed in a criminal justice system that treats you better if you are rich
  • death is today a cruel and unusual punishment prohibited by the Clause
  • no credible evidence that the death penalty deters crime more effectively
