Article 1: Legislative branch

  • Powers explained in article.
  • Structure is provided.
  • Where power is vested:Congress.
  • The constitution: Article one, 10

Legislative branch

  • Power in congress.
  • Bicameral congress: Two houses.
  • 1. House of representatives: 435 representatives, based on census.
  • 2. Senate:100 senators, 2 per each state.
  • Makes the laws.

Powers of Congress

  • Exist implied and enumerated powers.
  • Not in constitution vs written in constitution.
  • E: impose an collect taxes, regulate commerce(trade), regulate currency. 
  • I: create national banks, prohibit discrimination, draft a military.
  • E: borrow money from budget.  I: take actions for wealfare of country.

Law Making Process

  • Equal voices, votes, and representation.
  • Effective 2/3 system, majority wins.

  • Long process; Need various approvals
  • Two houses with a same bill = great argument .

How a bill becomes a law

  • Bill is introduced and presented to committee in House of Representatives.
  • Committee considers, examines, finds worthy and sends to floor.
  • changes made in the floor(h), bill debated, 3/5 votes and approved(s).
  • Approved then send to other house(Senate), steps 1-3, then up for debate.
  • Both houses debate & agree on bill, sent for president approval, veto/pass.

  • A cycle system between the three.
  • Legislative: Impeach the president(executive), begin new courts(judicial).
  • Executive: Veto the laws(legislative),  appoint judges/officials(judicial).
  • Judicial: determine laws unconstitutional(Legislative)
  • Judicial: determine president's actions unconstitutional(executive).

Benefits of the system

  • Balance power between the three.
  • One never as strong as the two combined.
  • Prevent corruption or abused of power by branches.
  • Sets in motion proper management of their role.
  • Allow the three to check the power of each other.
