PRESENTATION OUTLINE

MIRANDA V. ARIZONA

In1963, Ernesto Miranda was arrested for rape, kidnapping, and robbery. He confessed and was given 20-30 years in a federal prison.

Miranda said that police unconstitutionally obtained his confession so he appealed to the US Supreme Court

The Supreme Court ruled in a 5-4 decision that the prosecution could not introduce Miranda's confession in trial since police failed to inform him of his rights.

Since Miranda was unaware, and not given, his rights, his time in prison was cut from a max of 30 years, to 1 year and 1 day.

Police officers are now required to inform a suspect of their 5th and 6th amendments while making an arrest. This is called the "Miranda Rights"
