COPYRIGHT INFRINGEMENT

Infringement: Breaking the terms of a law or agreement. The action of limiting, undermining, or violating.

Copyright Infringement: Using works protected by copyright laws without permission. Producing, disturbing, displaying, or performing copyrighted merchendise, artworks, or performances.

Legal penalties for copyright infringement:

-Infringer pays the amounts of damages and profits.

-The Court can issue an injunction to stop the infringement

- Court can seize the illegal work.

-The infringer can go to jail.

In 2008 Larrikin Music, owners of copyright in the song "Kookaburra Sits in the Old Gum Tree" sued the band Men at Work for copyright infringement, claiming the flute riff in the 1981 hit "Down Under" was copied from their song. Men at Work said it was just a coincidence, and the riff had only a tiny part in their song.

JK Rowling, author of the Harry Potter series, bought a copyright infringement case against Steven Vander Ark, a teacher and librarian who had attempted to publish a Harry Potter encyclopaedia.

A small cafe in Germany by the name of Apfelkind “apple child” received a letter this year from Apple. Apple stated that they wished to prevent the cafe from using an Apple as their logo.
Apple was concerned that the logo could confuse customers and cause people to assume that the cafe was connected to Apple.
