Teacher Removal of a Student

  • Discretionary: Informal...principal's office/Formal...disruptive Conduct
  • Mandatory: Conduct that requires DAEP placement or expulsion

A teacher may remove a student:

  • Who repeatedly interferes with teacher's ability to communicate with students or with the ability of student's to learn; or Whose behavior is so unruly, disruptive, or abusive that it seriously interferes with the teacher's ability to communicate effectively with students or with the the ability of student's classmates to learn. (4-1)

What questions should a teacher ask prior to removal?

  • Removal Conference: must be held within 3 school days
  • student must be given written notice of the reason for the removal
  • student must be given an opportunity to respond (4-3)

Pending the conference, the principal may:

  • maintain the student in the office
  • place the student in a DAEP;
  • Place the student in another appropriate classroom (4-3)

Following the conference, the principal may:

  • Place the student in another appropriate classroom
  • place the student in DAEP;
  • Expel the student; or
  • Place the student back in the class with the teacher's consent.

  • A principal cannot return the student to a teacher's class without the teacher's consent unless-The placement review committee determines that such placement is the best or only alternative.

Composition of Placement Review Committe

  • Two teacher members and one alternate selected by the faculty
  • One professional staff member chosen by the principal (4-4)

David's law Explained

  • Effective Sept. 1, 2017, David’s Law addresses the need for Texas laws to keep pace with evolving technology. It requires school districts to include cyberbullying in their district bullying policies and notify a child’s parents if he or she is a victim or alleged aggressor of bullying. The law allows schools to combat and prevent cyberbullying by investigating off campus cyber-assisted bullying if it materially affects the school environment. It provides for schools to collaborate with law enforcement when serious or life-threatening cyberbullying situations arise. In recognition of bullying as a mental health issue, David’s Law encourages schools to invest in counseling and rehabilitation services for both victims and aggressors of bullying.

Behavior RTI

  • Changing the function of a behavior takes time. At least 6-8 weeks
  • The most impact on students for changing behavior is creating a relationship with your students….. Hattie says it has a .73 impact on student achievement
  • Tell the students your unwritten rules… Have a clue for students so they knew what to do. "When I come to school and you see me put on this tie, it means that I am having a bad day or I am not feeling well. When this happens, it will no longer be a 3 strike and you’re out day. It will be a 1 strike and you’re out kind of day."
  • No dead man rules
  • All behaviors are associated with Functions, not with behavior goals § Gain attention § Escape § Communication
  • Rules must be explicitly taught to students so they know expectations
  • Implement Brain Breaks: 1 min of physical activity gives 10 min of academic time
