Unfunded Mandates Reform Act

(UMRA-1995) signed during Clinton admin.

Mandate

an official requirement given by the Federal government that must be met.

Main Provisions of the Act

  • federal agency must provide a general notice of when the rule was published
  • include a Fed. mandate that states funds by S.L.T.G. may be > $100mill/year
  • written statement includes legal authority, 
  • a cost-benefit assessment,
  • details of the macro-economics effects, and solutions to S.L.T.G. concerns

  • nationwide social reform in the 1950s led to passing of mandates by gov't
  • Acts such as the Clean Air (1963)
  • Voting Rights (1965)
  • The Americans with Disabilities (1990)
  • Nat'l gov't was trying to promote the environment, social equality, welfare

Why is this important?

  • prior to the U.F.M.R.A., the federal gov passed many mandates to states
  • these regulations were not funded and caused state/local gov to pay
  • which usually lead to a raise in local taxes
  • when states pay out of pocket, they use funds that could go toward schools,
  • and other local organizations

Effect

  • passing the U.M.R.A. led to the communication from state to federal gov't
  • curved the passing of unfunded mandates by the fed. gov't w/o legislative 
  • envolvement
