Updated Laws Impacting the Massage Industry

Law- enforceable rules governing relationships among individuals and between individuals and their society

Legal and Voluntary requirements and standards are implemented for the protection of society and, ultimately the CLIENT

Misdemeanor- a crime punishable by a fine or imprisonment up to 1 year


Felony- a more serious crime, punishable by imprisonment for a longer period

Malpractice- form of negligence, any wrongdoing by a professional and can refer to any professional misconduct, evil practice, or illegal or immoral conduct

Defamation of Character- Communication of false information to a third party about a person that results in injury to that person’s reputation

Invasion of Privacy- civil wrongdoing that refers to several wrongs involving the use of otherwise private information

Fraud- deception that is deliberately practiced to secure unfair or unlawful gain. (i.e. Third party insurance reimbursement)

Informed consent: client must be given enough information about the proposed treatment, in understandable language, to make an intelligent decision about whether to proceed with the treatment

Implied consent: unstated agreements that flow automatically from the relationship between the client and the massage professional

Negligence- failure to meet standards of practice that may lead to injury

Performance of an act that a reasonably careful person under similar circumstances would not do or the failure to perform an act that a reasonably careful person would do under similar circumstances

  • Failure to protect clients from allergic reactions
  • Use of defective equipment
  • Failure to observe client reactions to massage and take appropriate action
  • Hot stone burns
  • Disease/illness transmission
